Termination of Employment The decision to terminate employment can be an expensive one. There are many pitfalls for the unwary. Before making the decision to terminate, we guide our clients through the maze of statutory and common law rights, whether the desire to terminate is the result of misconduct, poor performance, attendance, restructuring, downsizing, or any of the other possible reasons. Our objective is to help our clients make the best possible decision for their organization, considering all of the various factors, including cost, statutory compliance and litigation risk. In preparing to terminate, we help our clients prepare appropriate and complete termination documentation, including letters, offers, releases, and notices to unions and/or government authorities where required. We also help our clients manage the process of dismissal to minimize disruption and liability. After termination, we help our clients evaluate and respond to inquiries, counter-proposals, demand letters, and other threats from the employee or their counsel. We provide strategic advice to allow that focus on our clients' business interests. We negotiate cost-effective resolutions of termination disputes, where doing so is in our clients' interests. We regularly assist employers in enforcing the non-competition and non-solicitation provisions of employment contracts and obtain court assistance in restraining former employees from unlawfully appropriating the trade secrets and corporate opportunities of our clients. Finally, we represent our clients in termination-related litigation at all stages, from preparing the pleadings, to mediation and ongoing settlement discussions, to conducting the trial.
