Union Avoidance
Union Avoidance Union organizing drives are unfamiliar territory for most employers. The costs of missteps -- whether legal or strategic -- can be high, and irreversible. Drawing on 40 years of experience dealing with labour relations generally, lawyers at Stringer Brisbin Humphrey have a deep understanding of the real factors that cause employees to unionize. We help employers focus on the "right" issues and how to address them by implementing the appropriate strategies and approaches for avoiding unionization. We are recognized as national leaders and leading educators in helping employers remain union-free. If an employer does become a target of an organizing campaign, we assist them in developing appropriate, creative strategies to maximize the chances of remaining union free. We are there to guide our clients every step of the way during this often very difficult time. We provide advice on how to exercise the right of free speech in a manner that is both effective and in compliance with the Labour Relations Act, the Canada Labour Code, and other relevant legislation. Where applications for certification or other proceedings arise we represent the employer at the relevant labour relations tribunal. Our objective is to assist our clients in using all lawful and appropriate means to remain union-free (if that is their wish), before, during and after an organizing campaign.
